If the performance by Aikya in accordance with the Terms or of any obligation hereunder is prevented or restricted by reason of force majeure such as (i) war, terrorist attacks, revolution, strike, epidemic, pandemic, civil commotion or acts of public enemies, acts of God, or other concerted industrial action or agitation in the region and the industry, or similar such events beyond Aikya’s reasonable control; or (ii) change in any applicable law, then Aikya shall, upon giving prior written notice to you, be excused from such performance to the extent that such cause prevents or restricts it to perform its obligations hereunder provided that it shall use its best efforts to avoid or remove such cause of non-performance and shall continue performance hereunder with the utmost dispatch whenever such causes are removed.
7. Governing Law and Jurisdiction
The Terms and any dispute over or interpretation of its provisions shall be governed by the laws of India.
The courts in Bangalore, India shall have exclusive jurisdiction over all matters arising pursuant to the Terms.
